AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Homemade Classes LLC, doing business as Homemade Cooking (“Homemade,” “we,” “us,” or “our”), concerning your access to and use of https://homemadecooking.com and any related pages, forms, media, or services that link to these Terms (collectively, the “Site”).

The Site provides access to free online cooking classes, events, digital materials, and related services (collectively, the “Services”). By accessing or using the Site or Services, you agree to be bound by these Terms of Use. If you do not agree with all of these Terms, you are expressly prohibited from using the Site and you must discontinue use immediately.

We may update these Terms from time to time. The “Last Updated” date above indicates when these Terms were last revised. Your continued use of the Site after any changes means you accept the updated Terms.

ELIGIBILITY

The Site is intended for users who are at least 18 years old. By using the Site, you represent that you are at least 18 years old, or that you are using the Site with the consent and supervision of a parent or legal guardian.

SERVICES ARE FREE; NO PURCHASES

Our classes and Services are currently offered free of charge. We do not accept payments through the Site at this time. We may change or discontinue any part of the Site or Services at any time.

CLASS REGISTRATION AND COMMUNICATIONS

When you register for a class, you may be asked to provide information such as your name and email address. We use this information to administer the class (for example, to send confirmations, reminders, access details, and class materials).

Marketing emails are optional. If you opt in to receive marketing communications from Homemade, you may unsubscribe at any time using the link provided in those emails.

For more information about how we collect and use personal information, please review our Privacy Policy, which is incorporated into these Terms by reference.

SPONSORED CLASSES AND PARTNER COMMUNICATIONS

Classes may be presented in partnership with a sponsor or brand partner. If you opt in during registration to receive communications from a sponsor, you authorize us to share your name and email with that sponsor for follow-up and marketing communications. Sponsor communications are governed by the sponsor’s own policies, and you can unsubscribe from sponsor emails directly through the sponsor.

CLASS RECORDINGS AND CHAT

Our live classes may be streamed and recorded (including via third-party platforms such as YouTube). By participating in a live class, you understand and agree that:

  • The class session may be recorded and made available for replay, promotional use, or archival purposes.

  • Participant chat messages submitted during a live session may be visible to other attendees and may appear in the recording.

  • You should not include sensitive personal information in chat messages.

Participants are not placed on camera or microphone during classes. However, by submitting comments in chat, you grant us a non-exclusive, royalty-free right to display, reproduce, and distribute those comments as part of the recorded class or related promotional materials.

ASSUMPTION OF RISK (COOKING + FOOD)

You understand and agree that cooking and food preparation involve inherent risks. These may include, without limitation, burns, cuts, allergic reactions, choking hazards, slips and falls, injuries from kitchen tools or appliances, and risks associated with food handling and food safety.

You are responsible for:

  • Ensuring your kitchen environment is safe

  • Using equipment properly and supervising anyone in your household who participates

  • Reviewing ingredient lists and taking precautions for allergies, intolerances, dietary restrictions, or medical conditions

  • Practicing appropriate food safety and handling procedures

If you have allergies, dietary restrictions, or medical concerns, you are responsible for consulting a qualified professional as needed before participating.

Participation is voluntary, and you assume all risks associated with your participation in any class or use of any recipes or materials provided through the Services.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site and all content on the Site or provided through the Services—such as text, recipes, class materials, videos, graphics, recordings, trademarks, logos, and other materials (collectively, “Content”)—are owned by us or licensed to us and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Content for your personal, non-commercial use. You may not copy, reproduce, distribute, sell, publish, or exploit any Content for commercial purposes without our express prior written permission.

USER REPRESENTATIONS

By using the Site, you represent and warrant that:

  1. Any information you submit is true, accurate, current, and complete.

  2. You will not use the Site for any illegal or unauthorized purpose.

  3. You will not attempt to access the Site through automated or non-human means (bots, scripts, scraping, etc.).

  4. Your use of the Site will not violate any applicable laws or regulations.

PROHIBITED ACTIVITIES

You agree not to:

  • Circumvent or interfere with security-related features of the Site

  • Disrupt the Site or networks connected to the Site

  • Impersonate another person or misrepresent your affiliation

  • Attempt to reverse engineer or exploit the Site’s code or systems

  • Use the Site to harass, abuse, or harm others

  • Use the Site in a manner inconsistent with these Terms or applicable laws

USER-GENERATED CONTENT (IF APPLICABLE)

If the Site allows you to submit comments, messages, reviews, or other content (“Contributions”), you are responsible for those Contributions. You agree not to submit content that is unlawful, abusive, hateful, infringing, misleading, or otherwise objectionable.

By submitting Contributions, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute those Contributions for purposes related to operating and promoting the Site and Services.

THIRD-PARTY WEBSITES AND CONTENT

The Site may contain links to third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party websites is at your own risk.

SITE MANAGEMENT

We reserve the right (but have no obligation) to monitor the Site for violations of these Terms and to take appropriate action, including restricting or terminating access to the Site, at our sole discretion.

DISCLAIMER

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Site will be uninterrupted, error-free, or secure.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your breach of these Terms, or your violation of any law or third-party rights.

MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Site at any time. We may also modify, suspend, or discontinue the Site or Services (in whole or in part) at any time without notice. We are not liable for any modification, suspension, or discontinuance.

GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles.

DISPUTE RESOLUTION

Before initiating any formal dispute, you agree to contact us at hello@withhomemade.com and attempt to resolve the dispute informally.

POCKETCHEF ADDENDA FOR HOMEMADE CLASSES LLC

These addenda are designed to be appended to Homemade Classes LLC’s existing Terms of Use and Privacy Policy. They describe the additional terms and privacy disclosures that apply to the PocketChef messaging service.

POCKETCHEF ADDENDUM – ADDITIONAL TERMS FOR MESSAGING SERVICES

PocketChef (“PocketChef”) is a free, messaging-based cooking and meal-planning assistant operated by Homemade Classes LLC. These additional terms apply to your use of PocketChef’s SMS, RCS, or other digital messaging services (collectively, the “PocketChef Service”) in addition to the general Homemade Terms of Use. If there is any conflict between these PocketChef terms and the general Terms of Use, these specific terms will govern your use of PocketChef.

1. MESSAGING CONSENT AND USAGE

By enrolling in PocketChef, you consent to receive recurring text or rich messages from Homemade Classes LLC and its technology partners. Message frequency varies. Standard message and data rates may apply. Reply STOP to cancel or HELP for assistance. You must be at least 18 years old to participate.

2. TECHNOLOGY AND THIRD-PARTY SERVICES

PocketChef uses third-party technologies to operate and deliver the Service, including but not limited to Twilio Inc. for SMS and RCS message delivery, Google LLC for RCS capabilities, Amazon Web Services (AWS) for hosting and data storage, and Anthropic Claude (via Amazon Bedrock) for natural-language processing and conversational features. These providers process data only on our behalf and under strict confidentiality and security obligations.

3. RETAIL PARTNERS (E.G., SAFEWAY)

We may share limited, non-sensitive information such as phone numbers and aggregated usage activity with participating retail partners like Safeway. This data helps measure how PocketChef interactions relate to in-store or online engagement. Our partners are contractually required to protect this information and may not use it for independent marketing or unrelated purposes.

4. COOKING GUIDANCE DISCLAIMER

PocketChef provides general cooking information and suggestions. It does not constitute professional culinary, dietary, or safety advice. You assume full responsibility for using your own judgment in food preparation, storage, and consumption. Homemade Classes LLC disclaims all liability for injury, illness, or damages arising from reliance on PocketChef content.

5. LIMITATION OF LIABILITY

Because PocketChef is a free service, Homemade Classes LLC’s total liability to you for any claim related to the PocketChef Service shall not exceed the greater of (a) $100 or (b) the total amount you have paid us in the past 12 months (if any). We are not liable for any indirect, incidental, or consequential damages arising from your use of PocketChef.

6. GOVERNING LAW

These PocketChef terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any disputes will be resolved exclusively in the state or federal courts of King County, Washington.

POCKETCHEF ADDENDUM – ADDITIONAL PRIVACY DISCLOSURES FOR MESSAGING SERVICES

PocketChef (“PocketChef”) is a free cooking and meal-planning messaging service operated by Homemade Classes LLC. This addendum supplements the Homemade Privacy Policy and explains how we collect, use, and share data specifically related to PocketChef’s SMS, RCS, and conversational features.

1. INFORMATION WE COLLECT

When you use PocketChef, we may collect contact information (your mobile phone number), message content (recipe requests or feedback), device and usage data (carrier, device type, timestamps), and optional preferences (dietary restrictions). We do not intentionally collect payment data, precise location, or sensitive health information.

2. HOW WE USE THIS INFORMATION

We use this information to deliver and personalize cooking tips, operate and improve the service, measure engagement and effectiveness (including with retail partners), and maintain compliance with messaging regulations.

3. DATA SHARING

We share data only with trusted technology providers who process it on our behalf under confidentiality obligations, including Twilio Inc., Google LLC, Amazon Web Services (AWS), and Anthropic Claude (via Amazon Bedrock).

We may also share limited, non-sensitive data (such as phone numbers and related usage activity) with retail partners like Safeway to help evaluate PocketChef’s impact on customer engagement and sales. Partners are contractually prohibited from using this data for independent marketing or unrelated purposes.

4. RETENTION

We retain opt-in and opt-out records for at least four years and message logs for up to 24 months for quality and compliance purposes.

5. YOUR RIGHTS

You may reply STOP to any PocketChef message to opt out, email privacy@homemadeclasses.com to request access, correction, or deletion of your data, or reply HELP in any PocketChef thread for quick support options.

6. SECURITY

We use industry-standard security controls, including encryption and restricted access, to protect PocketChef data. No system is entirely secure, and you use the service at your own risk.

7. CHILDREN’S DATA

PocketChef is intended for adults 18 and older. We do not knowingly collect or process data from anyone under 18. If such information is discovered, it will be deleted promptly.
